Non-exempt drivers are facing severe penalties for not complying with the ELD mandate. Fines for ELD violations could range from $1,000 to $10,000. According to the North American Transportation Association, a failure to comply with 395.8(a) has an average fine of $2,867. The highest recorded fine is $13,680.
All applicable hotshot drivers and carriers must comply with the ELD mandate. Drivers should be aware of their responsibility to keep Records of Duty Status (RODS), electronic logs, and maintain their electronic logging devices (ELD).
Guidance: Yes. An ELD can be on a smartphone or other wireless device if the device meets the ELD rule's technical specifications. If the device is a portable it must be mounted in a fixed position during commercial motor vehicle (CMV) operation and visible to the driver from a normal seated driving position.
The short answer is no. Some operations of commercial motor vehicles are not subject to the same logging requirements as trucks in interstate commerce. Under the ELD rule, drivers who use the Short Haul exemption with time cards are not required to keep records of duty status (RODS) or use ELDs.
Who must comply with the electronic logging device (ELD) rule? The ELD applies to most motor carriers and drivers who are currently required to maintain records of duty status (RODS) per Part 395, 49 CFR 395.8(a). The rule applies to commercial buses as well as trucks, and to Canada- and Mexico-domiciled drivers.
Announcing ELD Disconnects, a new ELD feature that will alert you when a device is unplugged. You never again have to worry that an unplugged ELD will result in a violation; you will be alerted right when the driver connects again.
The 100 air-mile exemption, which is in the regulations at §395.1(e)(1), allows a driver to use a time record in place of a log, provided that certain conditions are met. While this is possibly the most widely used hours-of-service exemption, it may be the most commonly misused exemption, as well.
Instead, electronic logging devices will be responsible for logging hours of service. As such, a truck without an ELD and no way to provide an accurate service log will be considered as a violation of hours of service guidelines.
